Overview

We are seeking to fill the role of Regulatory Enforcement & Privacy Counsel. The ideal candidate enjoys collaborating with clients, industry partners and internal teams to maximize outcomes for homeowners. 

Responsibilities

• Represent LoanCare during federal, state and regulatory audits. Communicate, written and orally, with regulatory agencies in coordination with LoanCare’s Exam Management team.
• Thorough analysis and understanding of complex regulations with ability to proactively identify potential regulatory compliance issues and advise management on risk mitigation strategies.
• Advise LoanCare on data privacy laws and regulations, ensuring compliance as well as legal advice on data privacy issues related to data collection, storage, processing, sharing and disposal; often working with internal teams to implement data protection measures and
manage privacy concerns.
• Advise and manage data incident response, including but not limited to communications with regulators and customers. Serve as LoanCare’s point of contact on all privacy issues.
• Draft and/or review responses related to escalated complaints.
• Review and analysis of suspicious and/or fraudulent servicing transactions; conduct thorough investigations to gather supporting evidence for possible actions.
• Provide support to managing attorney for major litigation including but not limited to class actions.
• Employ strategic use of outside counsel, collaborate and manage the progression of each assigned manner, including budgets and tracking of deadlines.
• Timely and accurately respond to operational legal inquiries and provide necessary legal support to operational undertakings.
• Maintain culture that mandates ethical conduct and a commitment to regulatory compliance.
• Participate in committee meetings and offer legal guidance.
• All other duties as assigned. 

Qualifications

• Juris Doctor from an ABA accredited law school.
• Active bar member in good standing.
• 8+ years of related experience in mortgage servicing industry
• Remain current and knowledgeable about applicable state and federal laws and regulations pertaining to the subservicing and servicing of residential mortgage loans, including but not limited to TILA, RESPA, ECOA, HPA, FHA, FCRA, FTC regs, GLBA, UDAAP, FDCPA, BSA/AML,
advertising compliance, SAFE Act, Fair Lending and CFPB rules and regulations

• Excellent verbal and written communications skills with the ability to summarize and communicate complex information in plain language to regulators, clients, outside counsel and LoanCare upper management.
• Ability to simultaneously manage a wide range of projects and effectively meet deadlines in a fast-paced and dynamic environment. Excellent time management and organizational skills a must.
• Thorough knowledge of mortgage origination, closing, and servicing practices; various mortgage loan products such as conventional, ARMs, HELOC; loan documents (note, mortgage/deed of trust, etc.) and understanding of various Federal agencies and GSEs.
• Extensive experience researching, interpreting and articulating legal issues (Westlaw or LexisNexis).
• Ability to work both independently and in a team setting.
• Ability to identify deficiencies and opportunities for improvement.
• Ability to interpret and apply applicable laws and regulations to LoanCare’s business functions.
• Experience working directly with management on servicing issues.
• Ability to travel as needed.

Work Conditions 

Able to attend work and be productive during normal business hours and to work early, late or weekend hours as needed for successful job performance. Overtime required as necessary.
